Litigation in the UAE
Litigation in the United Arab Emirates spans three distinct court systems. UAE Mainland courts operate under the Civil Procedure Code and conduct proceedings in Arabic, applying federal civil and commercial law. ADGM Courts apply the ADGM Civil Procedure Rules in English under a common-law model, while DIFC Courts operate under the DIFC Courts Rules, also in English and on common-law principles. Each system has its own procedures, evidence rules and enforcement pathways, and the choice of forum often turns on the governing law of the contract, the location of assets and the parties' preferences. At QAF Legal, our litigation team represents companies and individuals across all three forums in commercial disputes, debt recovery, breach of contract, real estate, employment, construction and civil claims. We assess strategy at the outset — whether to litigate, settle or pursue alternative resolution — and we manage cases through trial, judgment and enforcement. Our advocates are comfortable in both Arabic-language mainland proceedings and English-language common-law hearings, which is decisive in cross-jurisdictional disputes where evidence, witnesses and assets span more than one system.
Our Litigation Services
Commercial Disputes
We represent plaintiffs and defendants in high-value commercial disputes before UAE, ADGM and DIFC courts, managing strategy, evidence, disclosure and cross-examination from claim through judgment and costs.
Debt Recovery & Civil Enforcement
We pursue debt recovery through demand, installment orders, attachment and execution, handling disputed and undisputed claims across mainland and free-zone courts and coordinating enforcement against assets in each jurisdiction.
Breach of Contract
We advise on contractual breaches, repudiation, damages and specific performance, quantifying loss and pursuing or defending claims grounded in commercial contracts of every kind.
Real Estate Disputes
We litigate sale, lease, escrow, off-plan, handover and ownership disputes across mainland courts, DIFC and RERA-linked forums, and we handle developer and broker claims.
Employment Litigation
We represent employers and employees in termination, unpaid entitlement, non-compete and end-of-service disputes before mainland labour courts and DIFC, and we handle structuring-driven disputes.
Construction Disputes
We handle construction claims for delay, defects, variation and payment across mainland courts and arbitral forums, coordinating with quantum experts and engineers.
Enforcement & Recognition
We enforce UAE, DIFC and ADGM judgments and arbitral awards, and we obtain recognition and enforcement of foreign judgments and awards under the relevant treaties and local procedures.
Injunctions & Urgent Relief
We secure freezing injunctions, asset preservation, disclosure orders and other interim relief to protect clients' positions before and during substantive proceedings.
Jurisdictions We Cover
We practice across UAE Mainland, ADGM and DIFC. Mainland litigation proceeds in Arabic under the Civil Procedure Code with cassation to the Federal Supreme Court. DIFC Courts operate in English on common-law principles with a specialist, internationally respected judiciary. ADGM Courts apply common-law procedure in English with their own rules and registry. We also coordinate the recognition and enforcement of judgments and awards across these systems and abroad.
Strategy & Cost Discipline
Litigation is an investment, and we manage it accordingly. We map the risks, costs and likely outcomes at the outset, revisit strategy as the record develops, and pursue settlement where it serves the client. We are candid about weak claims and robust on strong ones, and we keep clients informed at every stage so decisions are taken with eyes open.
Why Choose QAF Legal
Our litigation practice is built on dual Arabic-language mainland and English-language common-law advocacy, which few firms combine. We are senior-led: partners run the strategy and the courtroom, not just the file. We integrate litigation with our arbitration, corporate and real estate teams to see the commercial picture behind the dispute. We pursue outcomes, not process for its own sake. The result is litigation advice that is strategically sharp, cost-conscious and built to win or settle on the best achievable terms.
Alternative Dispute Resolution & Early Settlement
Not every dispute belongs in court. We assess each matter for mediation, negotiation and early-settlement opportunities, and we structure without-prejudice and offers-to-settle to shift risk and cost onto an unreasonable opponent. Where settlement serves the client, we negotiate and document binding settlements, releases and compliance mechanisms. Where litigation is necessary, we still pursue every reasonable off-ramp, because the best result is often the one achieved without a judgment. Our dual-track mindset — litigate with conviction, settle with commercial sense — keeps clients in control of cost and risk throughout.
Group & Multi-Party Litigation
Modern disputes often involve multiple parties, guarantors, related companies and third parties whose joinder determines recovery. We coordinate multi-party litigation across defendants, guarantors and insurers, managing the procedural and strategic interplay between them. We trace assets and corporate structures, pursue piercing claims where warranted, and defend directors and shareholders against improper claims. By seeing the group as a whole, we recover more effectively and defend more coherently.
